Warri Judge Sentenced Man 22 To Death By Hanging For Stealing N955, 600
A 22-year-old man, Julius Aboy was yesterday sentenced to death for stealing N955, 600 by a Delta State High Court sitting in Warri according to The Sun Newspapers.

Where has this judge been all this while politicians are looting Nigeria dry to the bone marrow? He wants to kill a man for stealing N955,600! Is it fair really? If stealing approximately N1,000,000 gets one death by hanging, population of corrupt politicians and officials in Nigeria must have been drastically reduced if religious and judiciously implemented!!!

The trial judge, Justice Marshal Mukoro of High Court 1, who handed down the sentence told the convict that he is to die by hanging.

The convict was arraigned on a two-count charge of conspiracy to commit armed robbery and armed robbery, offences punishable under Sections 6(b) and 1(2)(a) respectively of the Robbery and Firearms (Special Provisions) Act Cap. RII Volume 14, Laws of the Federation of Nigeria, 2004.
In the first count, Julius Aboy and others now at large were reported to have on or about the 4th day of March, 2011 in Warri, conspired with others now at large to commit armed robbery.

In the second count, Julius Aboy and others now at large were also reported to have, on or about the 4th day of March, 2011 in Warri, robbed one Godwin Gwuene of N955, 600, while armed with a gun. The money was said to be Ususu contribution (savings), belonging to workers, serving as cleaners in a company in Warri.

The armed robbery gang, of which Aboy was allegedly a member, ran out of luck when an oncoming vehicle knocked down their getaway motorbike at the scene of the crime, leading to the arrest of the convict and killing of another member of the gang by an angry mob.

Justice Mukoro said the excuse of poverty, which the convict gave as reason of dropping out of school and venturing into crime was not tenable, as poverty was not a licence for criminality

He was said to have been contracted by a pastor of a certain white garment church to commit the act for ritual purposes.

Also, the Department of State Services, DSS in Delta state said they have secured convictions of eight persons at different courts in the State involving kidnapping.

A statement signed by Mr. A.P. Disi on behalf of the State Director said, "pursuant to efforts of the Delta State command of the Service in addressing the problem of kidnapping and threat of life of members of the public, so far in 2012, eight persons have been convicted in court out of the numerous cases being investigated by the command".

Sentencing the farmer to death, Justice Theresa Diai stated that "having found Chukwutem Eke guilty for the murder of Chukwudi Ossai, I hereby sentence you to death that you be hung by the neck until you be dead. May God have mercy on your soul".

Prosecution led by Mr. O.F. Court sentences man to death for stealing N1,705 cash & N400 milk

A Jos High Court on Thursday sentenced a 26-year-old man, Obinah John, to death by hanging for robbing one Dorothy Olaniyi of N1,705. The convict was also sentenced to death for robbing Olaniyi of two rolls of peak milk in sachets, valued at N400.

The prosecution counsel, Mr G. D. Fwonyon, who is the deputy director, Public Prosecution in Plateau State had told the court that John, in company with an accomplice, also named John, now at large, robbed the woman on November 18, 2005 in her shop at Gada Biu, Jos at gunpoint.
He told the court that John and his accomplice, having allegedly conspired and used a gun to rob Olaniyi, had committed a criminal offence punishable by hanging.
But John’s counsel, Mr. Tobechukwu Kekemeke, rejected the prosecutor’s claim, and accused the police of “not telling the truth about the gun” said to have been used by John.

Kekemeke pointed out that the police presented three statements, with only the last indicating a confession by the accused that he used a gun against the victim.

The defence counsel further argued that the prosecution had failed to prove to the court that the accused actually used a gun to commit the act.

He asked the court to throw out the case for lack of diligent prosecution, arguing that “the circumstances of the third statement, in which John was said to have admitted ownership of the gun, is suspect.”
In a 60-page judgment, Justice Yargata Nimpa said the evidence before the court had shown that the accused committed the offence and sentenced John to death by hanging.

“The accused is hereby sentenced to death by hanging, but the judgement is liable to an appeal,” Nimpa declared.

Kekemeke told the News Agency of Nigeria that he would appeal against the verdict.
“The convict has the right to appeal against the judgment. It is not a judgment that we are satisfied with, so we are definitely going to appeal at the Court of Appeal,” he vowed.
